By accessing or using SativaHR's Human Resource Information System (HRIS) platform, web application, or mobile application (collectively, the "Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our Service.
2. Description of Service
SativaHR is a Software-as-a-Service (SaaS) HRIS platform that provides:
- Employee self-service portal
- Attendance and time tracking
- Leave management
- Overtime request and approval
- Employee data management
- HR reporting and analytics
3. Account Responsibilities
When using our Service, you agree to:
- Provide accurate and complete information
- Maintain the confidentiality of your login credentials
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activities that occur under your account
Your employer is responsible for managing user access and ensuring appropriate use within their organization.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or servers
- Transmit viruses, malware, or other harmful code
- Falsify attendance records or other data
- Share your account credentials with others
- Use automated systems to access the Service without permission
- Reverse engineer or attempt to extract source code from the Service
5. Intellectual Property
The Service, including its original content, features, and functionality, is owned by SativaHR and is protected by international copyright, trademark, and other intellectual property laws.
Your employer retains ownership of all employee data entered into the system. We do not claim ownership of your data.
6. Service Availability
We strive to provide reliable service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:
- Scheduled maintenance (we will provide advance notice when possible)
- Emergency repairs
- Factors beyond our reasonable control
7. Limitation of Liability
To the maximum extent permitted by law, SativaHR shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from:
- Your use or inability to use the Service
- Any unauthorized access to your data
- Any interruption or cessation of the Service
- Any errors or omissions in the Service
Our total liability for any claims arising from your use of the Service shall not exceed the amount paid by your employer for the Service in the twelve months preceding the claim.
8. Indemnification
You agree to indemnify and hold harmless SativaHR from any claims, damages, losses, or expenses arising from your violation of these Terms or your misuse of the Service.
9. Termination
We may suspend or terminate your access to the Service immediately, without prior notice, if:
- You breach these Terms of Use
- Your employer's subscription is terminated
- Required by law
Upon termination, your right to use the Service will cease immediately.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website. Your continued use of the Service after changes constitutes acceptance of the new Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict of law provisions.
